1. Agreement & definitions
These Terms & Conditions ("Terms") are a legal agreement between Voipcom System, a company operating in Pakistan ("voipcom", "we", "us", "our"), and the business or individual subscribing to our services ("the Client", "you"). "The Service" means any of voipcom's cloud call center, cloud PBX, business automation, or Pakistani DID number offerings, including any related software, mobile or desktop apps, dashboards and support.
By creating an account, signing an order form, or using the Service in any way, you confirm you have the authority to bind your business to these Terms and that you accept them in full. If you do not agree, do not use the Service.
2. The service
voipcom provides a cloud-based communications platform: cloud PBX with extensions and IVR, cloud call center tools (dialer, queues, live supervisor dashboard), business automation (order-confirmation calls, AI voice agents, WhatsApp and CRM workflows), and Pakistani DID numbers with SIP delivery for AI voice agents. The Service is provided on a subscription basis as described on our pricing page or in a signed order form.
voipcom is a technology provider that sits on top of licensed telecom infrastructure. We are not ourselves a Long Distance and International (LDI) or Local Loop (LL) carrier; the underlying voice and number services are delivered through PTA-licensed operators we work with.
3. Acceptable use
The Service may only be used for lawful business communication. The Client agrees not to use the Service, and not to permit any employee, agent or contractor to use the Service, for:
- spam, robocalling, or unsolicited bulk calling or messaging campaigns that ignore consent or opt-out requests;
- harassment, threats, or abusive conduct toward any call recipient;
- deceptive, fraudulent, or misleading calling, including impersonating another person, business or government body;
- any activity that violates the Telecommunications (Re-organization) Act, PTA regulations, the Prevention of Electronic Crimes Act (PECA), or any other applicable Pakistani law; or
- attempting to circumvent, probe, or interfere with the Service's security, metering, or call-routing infrastructure.
We may investigate suspected violations and cooperate with law enforcement or PTA where required.
4. Regulatory compliance (PTA & DNCR)
voipcom operates through PTA-licensed infrastructure. However, compliance with PTA regulations, including the Do Not Call Registry (DNCR), consent requirements for marketing calls, and all other applicable telecom and consumer-protection laws, is the sole responsibility of the Client as the end user of the Service.
The Client is responsible for maintaining its own suppression lists, honoring opt-out and do-not-call requests promptly, and ensuring every campaign, IVR flow, or automated call run through the Service complies with DNCR and any other regulatory register that applies to it. voipcom may, at its discretion, provide tooling to help manage suppression lists, but this does not shift legal responsibility away from the Client.
5. Client responsibility for calls made
voipcom provides the calling platform, numbers and infrastructure only. The Client is solely responsible for:
- who is contacted through the Service, and on what basis;
- the content, script and purpose of every call, IVR message, or automated voice interaction made through the Service, including marketing, sales, order-confirmation and collections calls;
- obtaining any consent required by law before contacting a number, including for AI voice agents configured by the Client or its integration partners;
- the accuracy of any claims made on those calls; and
- any claim, complaint, regulatory fine, or legal action arising from calls or messages made through the Service, including allegations of fraud, misrepresentation, or harassment.
voipcom is not liable for the legality, accuracy, or outcome of any call or message placed by the Client, its staff, its agents, or any AI/automation configuration the Client sets up on the Service. Our role is limited to providing, hosting, and billing for the Service, not to reviewing or approving individual calls or campaigns.
6. Phone numbers & DIDs
City DID numbers (e.g. 021, 042, 051) and any mobile numbers provisioned to the Client remain licensed through voipcom's PTA-licensed operator partners. Numbers are allocated for the Client's use for the duration of an active subscription and in accordance with PTA numbering rules. Numbers may not be resold, sub-leased, or ported to a third party except where PTA rules and our operator agreements permit, and porting requests are subject to the relevant operator's process and timelines, which are outside voipcom's direct control.
If a subscription lapses or is terminated, voipcom reserves the right to reclaim and reassign the associated number(s) after any notice period stated in the Client's order form.
7. Billing, plans & payment
Plans are billed monthly in Pakistani Rupees (PKR) as described on our pricing page or in a signed order form, and are subject to fair usage where noted (for example, unlimited Pakistani calling plans, which cover mobile and landline numbers). Fees are due in advance unless otherwise agreed in writing. Late or failed payment may result in suspension of the Service under Section 12.
Prices may be revised from time to time; where this affects an active subscription, we will give reasonable advance notice before the change takes effect on the next billing cycle. Taxes, levies, or regulatory surcharges applicable under Pakistani law are the Client's responsibility in addition to the quoted plan price unless stated otherwise.
8. Call recording & data
Calls made through the Service may be recorded for quality, training, and dispute-resolution purposes, as configured by the Client. The Client is responsible for informing call recipients where required by law, and for handling recorded data, transcripts, and call metadata in line with applicable data-protection obligations. See our Privacy Policy for how voipcom itself handles data collected in operating the Service.
9. Availability & support
voipcom works to keep the Service available and reliable, but the Service depends in part on third-party carriers, internet connectivity, and infrastructure outside our direct control, and we do not guarantee uninterrupted or error-free operation. We will provide support in line with the plan or agreement the Client has subscribed to, and will make reasonable efforts to notify Clients of planned maintenance that may affect service.
10. Intellectual property
All software, dashboards, branding, documentation and underlying technology that make up the Service are and remain the property of voipcom or its licensors. The Client is granted a limited, non-exclusive, non-transferable right to use the Service for its own internal business purposes during an active subscription. Nothing in these Terms transfers ownership of any voipcom intellectual property to the Client.
Data, recordings, scripts, and configurations that the Client creates or uploads while using the Service remain the Client's property, subject to voipcom's right to process them as necessary to provide the Service.
11. Limitation of liability
To the maximum extent permitted by law, voipcom's total liability arising out of or relating to the Service is limited to the fees paid by the Client for the Service in the month in which the claim arises. voipcom is not liable for indirect, incidental, special, or consequential loss, including loss of business, revenue, goodwill, or reputational harm, arising from the Client's use of the Service, the content of calls made through it, or third-party carrier or internet outages.
12. Suspension & termination
voipcom may suspend or terminate the Service, with or without prior notice where reasonably necessary, if it believes the Client is using it for fraudulent, harassing, or otherwise unlawful calling activity, or if payment is significantly overdue. Where practical, we will give notice and an opportunity to remedy the issue before suspending a Client acting in good faith.
Either party may terminate a subscription in line with the notice period stated in the Client's order form or plan terms. Termination does not relieve the Client of any fees already due for the Service provided up to the termination date.
13. Changes to these terms
These Terms may be updated from time to time to reflect changes in our Service, applicable law, or regulatory requirements. We will update the "Last updated" date at the top of this page when changes are made. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
14. Governing law
These Terms are governed by the laws of the Islamic Republic of Pakistan, and any dispute arising under them is subject to the exclusive jurisdiction of the courts of Pakistan.
Questions about these Terms can be sent to sales@voipcomsystem.com, or via our contact page.
